PRACTICE GROUP DESCRIPTION

Callister Nebeker & McCullough’s energy law practice involves representation of clients in a broad range of energy matters before federal, state and local courts, agencies and entities. The firm has represented developers of gas, biofuels, geothermal, waste coal, coal and wind projects. Our attorneys’ expertise includes obtaining governmental approval and related permits for energy production projects as well as representation for continuing operations and compliance. For example, for over 20 years our firm has represented a qualifying facility power plant selling electricity to PacifiCorp and has handled issues relating to the establishment of avoided costs, contracts, permits, financing, construction, operation and compliance.

Callister Nebeker & McCullough’s natural resources practice includes working with clients on natural resources issues including leases on federal and state lands. Our experience includes water right acquisition and the utilization of water in various projects, developments and operations.

Callister Nebeker & McCullough’s environmental law practice includes the representation of clients in property transactions involving environmental issues, cleanup and remediation of superfund sites, power plants, and water treatment plants and the reclamation of mined land. We routinely represent clients in actions involving federal and state environmental laws, including the Clean Water Act, the Clean Air Act, CERCLA, and RCRA. We have represented national and Utah based companies at superfund sites, including Manville Corporation and Boise Cascade. We appear before the United States Environmental Protection Agency, the Utah Water Quality Board, and the Utah Air Quality Board, the Utah Department of Environmental Quality and the Utah Department of Natural Resources.

Several of Callister Nebeker & McCullough’s attorneys have previously served in various capacities in federal and state government. This background is valuable in representing clients in energy, natural resources and environmental law matters and before governmental entities. Our attorneys have served in the Utah Attorney General’s Office, United States Department of Justice, the United States Department of the Interior, and on the Public Service Commission of Utah. Our lawyers have lectured on various energy, natural resources and environmental law issues to the Utah State Bar and other groups.
