PRACTICE GROUP DESCRIPTION

The Real Estate Practice Section handles a broad range of matters involving real property. These include purchase and sale transactions, real estate exchanges, financing, leasing, zoning, land use and development. Members of the Practice Group also have substantial experience in all areas of real estate litigation.

ENTITY FORMATION

Attorneys in the Real Estate Practice Group can assist clients in selecting and creating appropriate legal entities for the ownership, management, and development of real estate assets. Together with members of the Firm's Tax Section, attorneys in the Real Estate Practice Group can provide advice concerning the tax advantages of certain entities for certain types of projects.

FINANCING

Members of the Real Estate Practice Group handle both large and small real estate financing matters and have represented lenders and borrowers interests in these matters. The firm routinely handles documentation and negotiation of real estate loans including land development loans, construction loans, interim financing, and permanent financing for real estate projects. Members of the Real Estate Practice Group also specialize in low income and affordable housing financing as well as USDA 538 guaranty and subsidy transactions for rural development of multifamily housing.

LEASING

Attorneys in the Real Estate Practice Group are skilled in the preparation and negotiation of leases (representing either landlords or tenants) for all types of real property projects including shopping centers, office buildings, resort or recreational properties, residences and agricultural properties.

TRANSACTIONAL AND DEVELOPMENT

Attorneys in the Real Estate Practice Group have represented clients in all phases of transactional and development matters involving real estate. These matters include representing sellers or purchasers in real estate acquisitions and dispositions, real estate exchanges, real property due diligence reviews (such as reviewing title, survey and environmental matters), land planning and development and zoning issues. The attorneys assist clients in all aspects of development of residential, commercial, and office properties as well as condominium and planned unit development projects, including preparation of all project documentation such as declarations, covenants, conditions and restrictions, development agreements, easements, licenses, water rights and boundary issues. Attorneys in the Real Estate Practice Group also have substantial experience in developing low income and affordable housing projects as well as USDA 538 guaranty and subsidy transactions for rural development of multifamily housing.
