Marc Turman’s practice is concentrated in commercial litigation, appeals, arbitration, mediation, and bankruptcy.  He has represented and advised clients regarding contract disputes, real property disputes, unfair business practices and other business tort claims, product liability claims, intellectual property claims, bankruptcy matters, and employment disputes.  He has handled numerous appeals and argued cases in both federal and state appellate courts.

Marc conducts litigation for banks, including foreclosure litigation, collection litigation, and loan deficiency litigation.  He also provides legal advise to large and mid-sized banks on a wide range of issues, including loan workouts, foreclosures, lien analysis, fraudulent transfer analysis, lender liability, and regulatory compliance.

REPRESENTATIVE ENGAGEMENTS:

Litigation and Arbitration

  • Represented large and mid-size banks in foreclosure litigation, collection litigation, and loan deficiency litigation.
  • Represented Zions Bank in connection with a $130 million loan collection matter against a national homebuilder.
  • Represented successful dot-com company in $120 million complex corporate governance dispute by former director. Client prevailed after lengthy jury trial.
  • Represented seller of computer memory chips in dispute with manufacturer over price protection agreement. Client awarded $8 million verdict on cross-complaint after three month jury trial.
  • Represented new Salt Lake City school district in two week arbitration regarding the division of $1.3 billion in existing school district assets.

Appeals

  • Ivy Street Productions, Inc. v. Sony Pictures Entertainment Inc., No. B166233, 2005 WL 1484035 (Cal. Ct. App. June 23, 2005) (affirming defense verdict in case where creator of television show “Married . . . With Children” alleged millions of dollars in net profits were due under contract with show’s producer)
  • Matrixx Initiatives, Inc. v. Doe, 42 Cal.Rptr.3d 79 (Cal. Ct. App. 2006) (addressing the balance between Internet free speech and the rights of businesses to protect themselves from anonymous smears on Internet message boards)
  • Beckett v. MasterCraft Boat Co., 24 Cal.Rptr.3d 490 (Cal. Ct. App. 2005) (affirming summary judgment in favor of boat manufacturer in wrongful death action on grounds that federal maritime law barred plaintiffs’ damages claim)
  • Pinero v. Specialty Restaurants Corp., 30 Cal.Rptr.3d 348 (Cal. Ct. App. 2005) (holding that employer’s urging employee to abandon lawsuit against previous employer did not amount to retaliation under California Fair Employment and Housing Act)
